ITEM:  Correspondence and Reports

Westview Office Park

Chairperson Warren explained that she has received a letter from the Town Attorney regarding a public hearing being set for January 7, 2002.  Westview Office Park will be requesting that a lawn conservation easement be lifted.  Chairperson Warren thought that the easement was put into place by the Planning & Zoning Commission, Jeff will be researching this issue and will clarify this for the Commission.

Avery Brook Watershed

The Town has written a letter asking if they need to receive a permit in order to clean out the culverts.  Commission members discussed this issue and felt there could be a sedimentation maintenance issue at the site.  It was decided that the Town should do the necessary work and if a problem should arise, something could be presented to the Commission at that time.

It was the unanimous decision of the Commission to approve the minutes of November 7, 2001 and November 21, 2001 (with amendments).

ITEM:  Public Hearing

Mr. Peter DeMallie from Design Professionals came before the Commission to represent this application.  He explained that his client has encroached on wetlands on lot #90 and 91.  Ten thousand square feet of wetlands have been filled in order to erect a berm to give more privacy to these lots.  Mr. Pawlak is in attendance tonight to give the Commission a presentation on a mitigation plan being submitted, in turn for the berm to be retained as it stands.


Karen Isherwood from Design Professionals told Commission members that there were no calculations done on the downstream impact because there has been no change in the area of the watershed.  The quality of the wetlands downstream do not meet Army Corp. regulations and raising the elevation there has not changed the flow of the watershed.  Ms. Isherwood also informed the Commission that the holding capacity of the wetland has not diminished.

Commission members discussed the drainage of the berm and how it might effect the Town of Manchester.  Then the issue of the Town of Manchester being notified came up, as well as there was no paperwork showing that abutting property owners had been notified regarding this application.

Mr. DeMallie voiced on behalf of his client that he would be withdrawing this application.  A new application will be submitted at a later time and abutting property owners will be notified.  The Town of South Windsor is responsible for notifying abutting Towns.

Mr. Peter DeMallie from Design Professionals came before the Commission to represent this application.  He explained that Larry Cowles who resides at 965 Main Street would like to build a new house that is one story with a walkout basement on his property.  Mr. Cowles has an illness which precludes him from getting better and will require a one floor living environment.  The existing house at 965 Main Street was built in 1749 and sits on approximately 10 acres.  There is a 2-½ acre field on the property where Mr. & Mrs. Cowles would like to construct the house.  Mr. John Ianni has flagged the wetlands and has found that a part of the proposed lot will be within 80 feet of the wetlands.  The driveway design will be changed to a circular drive and will not infringe any further on the regulated area then it presently does.

Answering questions from the Commission, Mr. Cowles explained that there would be thinning of the trees due to his inability to clean out the gutters.  Commission members said that if any tree cutting were to take place on the West Side of the house lot on the steep slope, they would like Mr. Cowles to contact Jeff Folger.  Mr. DeMallie also said some white pines will be removed (ones that are in good shape will be replanted), in order to accommodate the house and driveway.

1.      One blueprint copy of the entire set of plans and this letter reproduced thereon, must be submitted to this Commission.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.

The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.

The permit is valid for five years and shall expire on December 5, 2006.  It is the landowner(s)/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.

4.      All approvals required must be obtained and submitted prior to any activity on the site.

A contact person shall be identified on the plans.

We recommend a bond in the amount of $2,000 be submitted to the Planning & Zoning Commission to ensure compliance with the Erosion and Sedimentation Control Measures.

Discussion with Jeff Folger, Environmental Planner/Conservation Officer prior to any tree cutting to the west of the house lot on the steep slope.

After looking at this application more, Chairperson Warren felt a public hearing for this application would be warranted because of the adjacent open space and also the number of abutters to this proposed subdivision.

Commission members discussed the need for a public hearing on this application because Town Hall has received some phone calls in regards to this issue.  The project is also fairly close to Chapel Hill Condominiums.
